AN ORDINANCE OF THE BOARD OF
COMMISSIONERS OF THE COUNTY
OF CARROLL RATIFYING THE FEES
CHARGED AND COLLECTED BY
THE SHERIFF OF CARROLL
COUNTY UNDER THE AUTHORITY
OF CARROLL COUNTY COUNCIL
ORDINANCE NO. 2009-11 AND REPLACING SAID ORDINANCE IN
CONFORMITY WITH IC 36-2-13-5.6
Findings
The Board of Commissioners of the
County of Carroll, of the State of Indiana (hereinafter referred to as “the
Board”) finds as follows:
The Carroll County Council, on October 20, 2009, adopted an ordinance,
Carroll County Council Ordinance No.
2009-11, entitled “Ordinance Allowing
the Carroll County Sheriff to Charge
Annual Sex Or Violent Offender Registration Fees and Sex or Violent Offender Address Change Fees.” lC
36-213-5.6 provides that such ordinance is to be adopted by the legislative body of the county, which is the
board of commissioners. The recitals
contained in said ordinance proposed
establishment of an annual sex or violent offender registration fee of fifty dollars and a fee of five dollars for each
time an offender registers a change of
address, both of which are permissible
under the statute. The text of the ordinance, however, authorized the Sheriff’s Office to charge fifty dollars for
each time a sex or violent offender registers an address change, which are inconsistent

with the recitals of the ordinance and contrary to statute.
Notwithstanding the error in the text
of said ordinance, the Carroll County
Sheriff’s Office has properly charged
an annual sex or violent offender registration fee of fifty dollars and a
change of address fee of five dollars
each, in reliance upon the authority
granted by the Carroll County Council,
but consistent with the limitations provided in the Indiana Code.
The Board desires to ratify the fees
charged and collected by the Carroll
County Sheriff’s Office since October
20, 2009, and to replace Carroll
County Council Ordinance 2009„11 in
conformity with IC. 36-2-13-5.6.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF
CARROLL, OF THE STATE OF INDIANA, AS FOLLOWS:
Section L Chapter 31 of the Carroll
County Code is hereby amended by
the addition of a new section, {31.07,
entitled “Sex or Violent Offender Fees”,
as follows:
31.07 SEX OR VIOLENT OFFENDER
FEES,
(A) The Carroll County Sheriff’s Office shall collect an annual sex or violent offender fee in the amount of fifty
dollars ($50.00).
(B) The Carroll County Sheriff’s Office shall collect a sex or violent offender address change fee of five
dollars ($5.00) each time that an offender registers a change of address.
(C) The Carroll County Sheriff’s Office shall transfer fees collected under
this section no less frequently than

monthly to the office of the Auditor of
Carroll County.
(D) The Carroll County Sex and Violent Offender Administration Fund is
hereby established.
(E) The Carroll County Auditor shall
monthly deposit ninety percent (90%)
of any fees collected under this section
to the fund established under subsection (D), above, and semiannually
transfer ten percent (10%) of any fees
collected under this section to the
treasurer of state.
(F) All sex and violent offender fees
charged and collected by the Carroll
County Sheriff’s Office since October
20, 2009 and transferred to the Carroll
County Auditor for deposit in the
county sex and violent offender administration fund are hereby ratified.
Section 2. All ordinances and parts
of ordinances in conflict herewith are
hereby repealed,
Section 3. The severability provisions of Carroll County Code 10.06
shall apply to each division or part of
this ordinance.
Section 4. Finding that an emergency exists, this ordinance shall take
effect immediately upon its adoption.

WHEREAS, there is in effect in the
Town of Yeoman, Indiana, Ordinance
#2002-3 designating Conditions Constituting Public Nuisance, the Town
Council of Yeoman, Indiana, now
AMENDS said Ordinance as follows:
IT IS HEREBY ORDAINED that a Public Nuisance of the Town of Yeoman includes the following:
(1) There shall be no livestock harbored by any resident of the Town of
Yeoman.
(2) Livestock is defined as the horses,
cattle, sheep and other useful animals
kept or raised on a farm or ranch and
includes, but is not limited to, chickens,
pigs of any nature, and other livestock
usually considered to be animals that
are on farms or other areas outside an
incorporated town.
(3) Dogs, when off of the property upon
which their owner or possessor lives
shall be restrained when off said property by a leash.
(4) Any offal of said dogs shall be
picked up by the person having the
dog on a leash and disposed of at the
residence of the walker.
(5) All other terms of said Ordinance
#2002-3 and any amendments thereto
shall remain in full force and effect for
enforcement of this Amendment.
(6) This Ordinance shall be in full force
and effect from and after its passage
and publication provided by law.
